The IRS continues to expand its role in requiring "best practices" of nonprofits as Congress and the states also express interest in this area. Endorsement agreements may be the next topic that gathers attention as a result of activities by AARP. At a minimum, 501(c)(6) organizations are on the IRS list for further scrutiny. Red Flags continue to fly at the FTC and a new Consumer Protection Bureau has been created under the recently adopted Dodd-Frank Act. Electronic discovery is a ticking time bomb that may eventually touch your organization. This program is designed to help your association stay ahead of the legal liability curve while serving the interests of its members.
Pre-Luncheon Program: "Cyber Liability: Opportunities & Risk in a Changing World"
Plan to also attend a 9 AM to 11 AM morning CSAE educational pre-session focusing on Cyber Liability. The world of cyberspace has created incredible opportunities for associations and their members -- from Facebook to YouTube to Twitter to websites. However, the potential for legal liability and risk remains. Copyright, defamation, invasion of privacy, antitrust and consumer protection laws are only a few of the issues that those entering cyberspace need to keep in mind. Policies for how these tools are used as well as privacy concerns are still under development. This program will raise some of the more interesting and challenging legal issues facing associations.
